Abstract

Sharia economics, which is based on Islamic principles, has developed significantly in various countries, including Indonesia. The basic principles of sharia economics include the prohibition of riba (interest), the prohibition of maysir (excessive speculation), and the prohibition of gharar (uncertainty), which place integrity, fairness, and transparency as key elements in sharia economic activities. However, along with the growth of the sharia finance and sharia banking industry, significant challenges have also emerged in the form of violations of sharia economic principles. These actions include fraud in sharia-based investments, money laundering in sharia transactions, violations of fund management principles, and so on. These kinds of actions not only harm society, but also threaten the integrity and development of the sharia economy which is based on the principles of the Islamic religion. In this context, the Prosecutor's Office as a law enforcement agency plays an important role in monitoring, enforcing the law and preventing sharia economic violations. The prosecutor's office is responsible for supervising, providing guidance, and ensuring that sharia economic actors comply with sharia principles. The prosecutor's office can also carry out prosecutions, implement court decisions and recover assets in sharia economic crime cases involving sharia banks or sharia business units. The Prosecutor's Office can also collaborate with other institutions related to sharia banking, such as Bank Indonesia, the Financial Services Authority, the Deposit Insurance Corporation and the Indonesian Ulema Council.

Abstrak

 

Ekonomi syariah, yang didasarkan pada prinsip-prinsip Islam, telah berkembang secara signifikan di berbagai negara, termasuk Indonesia. Prinsip-prinsip dasar ekonomi syariah mencakup larangan riba (bunga), larangan maysir (spekulasi berlebihan), dan larangan gharar (ketidakpastian), yang menempatkan integritas, keadilan, dan transparansi sebagai unsur-unsur kunci dalam aktivitas ekonomi syariah. Namun, seiring dengan pertumbuhan industri keuangan syariah dan perbankan syariah, muncul pula tantangan yang signifikan dalam bentuk pelanggaran terhadap prinsip-prinsip ekonomi syariah. Tindakan tersebut termasuk penipuan dalam investasi berbasis syariah, pencucian uang dalam transaksi syariah, pelanggaran prinsip pengelolaan dana, dan lain sebagainya tindakan-tindakan semacam ini tidak hanya merugikan masyarakat, tetapi juga mengancam integritas dan perkembangan ekonomi syariah yang berdasarkan prinsip-prinsip agama Islam. Dalam konteks ini, Kejaksaan sebagai lembaga penegak hukum memegang peran penting dalam pengawasan, penegakan hukum, dan pencegahan pelanggaran ekonomi syariah. Kejaksaan bertanggung jawab dalam mengawasi, memberikan panduan, dan memastikan bahwa pelaku ekonomi syariah mematuhi prinsip-prinsip syariah. Kejaksaan juga dapat melakukan penuntutan, pelaksanaan putusan pengadilan dan pemulihan aset terhadap perkara-perkara pidana ekonomi syariah yang melibatkan bank syariah atau unit usaha syariah. Kejaksaan juga dapat melakukan kerja sama dengan lembaga-lembaga lain yang terkait dengan perbankan syariah, seperti Bank Indonesia, Otoritas Jasa Keuangan, Lembaga Penjamin Simpanan dan Majelis Ulama Indonesia.
